Policies

These policies (hereinafter, the “Policies”) govern the use of the website "http://www.marpamanagement.com" (hereinafter, the “Portal”), owned by Marpa Management S.R.L. (hereinafter, “MARPA”), with its registered office at Boulevard Turístico del Este, Avenida España, corner Autopista del Coral - Placita La Ecológica 83, Higüey, Dominican Republic.

Conditions

Obligation of proper use of the Portal. The User undertakes to use the Portal, its content and the information contained therein in accordance with the law, these Policies, the Terms of Use, any Special Conditions, and other notices and instructions brought to their attention, as well as in accordance with public order, morality, and generally accepted good customs.

The User must refrain from obtaining or attempting to obtain the Content through means or procedures other than those that have been made available, indicated on the web pages where the content is located, or, in general, those commonly used on the Internet, provided that such means do not pose a risk of damage or rendering the Portal and/or its content unusable.

The User or third parties adversely affected by the receipt of unsolicited messages addressed to multiple recipients may notify MARPA by sending an email to: info@marpamanagement.com.

Intellectual Property Rights

All trademarks, trade names, or distinctive signs of any kind that appear on the Portal are the property of MARPA or third parties. The use or access to the Portal and/or its services shall not be understood as granting any rights to the User over such distinctive signs.

Likewise, the Content is the intellectual property of MARPA or third parties, and none of the exploitation rights that exist or may exist over said content are transferred to the User, except to the extent strictly necessary for the correct use of the Portal and its services. The User may consult, copy, store on their computer or any other physical medium, print, or reproduce the material available on this website solely for personal or private use, or within their company or organization, provided they acknowledge MARPA’s ownership rights at all times. Any alteration, modification, or decompilation of the content is strictly prohibited.

The commercialization, in any form and under any title, of the material contained on this site is strictly prohibited without MARPA’s prior written authorization. This portal may contain information from other sources, in which case consent must be obtained from such sources for reproduction.

Disclaimer of Warranties and Liability

Availability and continuity, usefulness, and reliability. MARPA does not guarantee the availability or continuity of the Portal’s operation. Whenever reasonably possible, MARPA will give prior notice of interruptions to the Portal’s operation. MARPA also does not guarantee the usefulness of the Portal for carrying out any specific activity, nor its reliability, and in particular (though not exclusively), whether the User can effectively use the Portal or access the different web pages comprising it.

Privacy and Security in the Use of the Portal

MARPA does not guarantee the privacy or security of the use of the Portal, and in particular does not guarantee that unauthorized third parties cannot gain knowledge of the type, conditions, characteristics, and circumstances of the User’s use of the Portal.

Quality

MARPA does not control or guarantee the absence of viruses or other elements in the Content that may cause alterations to the User’s computer system (software or hardware) or to electronic documents and files stored on their system.

Truthfulness, Accuracy, and Timeliness

MARPA excludes any liability for damages of any kind that may arise from the lack of truthfulness, accuracy, and/or timeliness of the content.

Legality, Reliability, and Usefulness

MARPA does not guarantee the legality, reliability, or usefulness of the services provided by third parties through the Portal.

Procedure in Case of Illicit Activities

EIf any User or third party considers that facts or circumstances exist which reveal the illicit nature of the use of any content and/or the carrying out of any activity on the web pages included in or accessible through the Portal, in particular involving the violation of intellectual property rights or other rights, they must send a notification to MARPA containing the following:
Personal details of the claimant: name, ID number (or passport in the case of foreigners), address, telephone number, and email;
Specification of the alleged illicit activity carried out on the Portal and, in particular, when alleging a violation of rights, a precise indication of the protected content and its location on the website;
Facts or circumstances that reveal the illicit nature of such activity;
In the case of a violation of rights, a handwritten or equivalent signature, along with the personal details of the holder of the rights allegedly infringed, or of the person authorized to act on their behalf;
An express, clear statement under the responsibility of the claimant that the information provided in the notification is accurate, and that the use of the content or the conduct described is unlawful.

Notifications

All notifications and communications (hereinafter, “Notifications”) from the User to MARPA shall be deemed effective, for all purposes, when sent by courier to the following address: Boulevard Turístico del Este, Avenida España, corner Autopista del Coral - Placita La Ecológica 83, Higüey, Dominican Republic.

Applicable Law

These Policies shall be governed in all respects by the laws of the Dominican Republic.

Jurisdiction

MARPA and the User expressly waive any other jurisdiction and submit to the courts of the Dominican Republic.
